Sponsor Terms

These terms cover sponsorship of Customs Finder. They are for brands buying a placement, not for people using the app. If you are looking for the terms that cover using Customs Finder, those are in our Terms of Use.

The short version

You buy placements on listings, by the month, invoiced monthly in advance. We publish within five business days of approved artwork and a paid first invoice, and change artwork within three.

We do not promise impressions, clicks or outcomes, and we do not offer exclusivity except on the search cards of a country partnership. If a listing you sponsor disappears, we substitute or extend rather than refund.

Sponsorship never influences our customs information. That is the whole reason crews trust the app, so it is not for sale at any price.

1. Who we are

Customs Finder is operated by Customs Finder Ltd ("we", "us", "our"), a company registered in England and Wales (company number 17372949), registered office Guillards Oak, Midhurst, W. Sussex. You can reach us at hello@customsfinder.com.

2. What these terms cover

These terms apply to every sponsorship you book with us. The commercial detail of your booking, which listings it covers, which placements, the dates and the fee, is set out in your order. The order and these terms together form the agreement between us. If the two ever conflict, the order wins.

We may update these terms. The version referenced by your order is the version that applies to it for the whole of its term, so a change never takes effect part-way through something you have already paid for. We attach a copy of that version to your order so both of us have a record of what was agreed.

3. What you are buying

Some words we use throughout, because the difference between them is what you are paying for:

  • A listing is a single entry in Customs Finder, for example Heathrow Terminal 5 Departures. A listing is the unit you buy.
  • A crossing is one airport, land border, port or rail terminal. A crossing usually contains several listings, split by terminal and by direction of travel. Heathrow, for example, is eight listings.
  • A country is every listing we publish in that country.

Placements available on a listing are the top banner, the feature card, or both. Fees are monthly. The rates that apply to you are the ones quoted on your order.

4. What we promise

We will publish your placement within five business days of us receiving your approved artwork and your cleared first payment, whichever is later.

We will make an artwork change within three business days of you sending us replacement files that meet our specifications.

Your placement will remain in the published catalog for the whole of the term set out in your order, subject to section 8.

Every placement also appears in the Sponsors and Offers screen in the app, and you may include one offer to the Customs Finder community.

5. What we do not promise

Customs Finder works offline. Once a crew has the app, listings and placements are read from a catalog already on the device, so there is no server for them to reach and no uptime figure that would mean anything. What we cannot control is when a given device next connects and picks up a new catalog. We therefore do not promise that any particular user will see your placement within any particular period.

We do not guarantee impressions, taps, enquiries, bookings or any other outcome. Customs Finder is a niche, focused audience and we sell it that way. Any figures we share about audience size or activity are estimates given in good faith and are not a term of this agreement.

Except for the country search cards described in section 7, we do not offer exclusivity or any guaranteed share of voice. Other sponsors may hold placements on the same listing, and where more than one sponsor holds a feature card the order is reshuffled on each visit.

6. Reporting

We do not provide impression or click reporting. If we start to, we will offer it to existing sponsors on the same basis, but it does not form part of what you are buying today.

7. Country partnerships

A country partnership gives you two distinct things, and it is worth being precise about where the exclusivity stops.

Exclusive: yours is the only sponsor brand shown on the search result cards for that country. We will not sell that position to anyone else while your term runs.

Not exclusive: the banner and feature placements you receive on every listing in that country sit alongside any other sponsor holding a placement on those same listings, on the rotation described in section 5.

New listings we publish in that country during your term are included at no extra charge.

8. Changes to listings

Customs desks close, terminals are renumbered, and we regularly split, merge and retire listings as we improve our coverage. If a listing you sponsor is withdrawn or merged during your term, we will offer you an equivalent listing at no extra charge, or extend your term to make up the lost time. If neither works for you, we will credit the unused portion of the fee for that listing.

This is the only remedy we offer for a listing becoming unavailable, and we will not owe you anything beyond it.

9. Your artwork and your offer

You keep ownership of your logo, artwork and brand. You grant us a licence to display them in Customs Finder, on our website and in our own marketing of the sponsorship programme, for the term and for a reasonable period afterwards in portfolio or case-study form.

You confirm that you own or are licensed to use everything you send us, and that your artwork, your description and your offer are accurate, lawful and not misleading. You are responsible for honouring any offer you publish through us, and for any claim arising from it.

We may decline or remove artwork or an offer that is unlawful, misleading, unsafe, that infringes someone's rights, or that we reasonably think would damage trust in Customs Finder. Where we can, we will tell you why and give you a chance to replace it. If we remove something and you do not replace it, the term continues to run.

10. Independence and labelling

Sponsorship buys placement. It does not buy influence over our customs information, the order of search results, which listings we add, or what we say about a crossing. We will not change or withhold intel because of a commercial relationship, and you agree not to ask us to.

Placements are advertising and we will present them so that crews can tell they are paid. We will not imply that you are recommended, endorsed or vetted by us, and you agree not to describe your sponsorship in a way that implies we have.

11. Fees, invoicing and VAT

Fees are as set out in your order and are payable monthly in advance. We invoice before each month of the term begins, and payment is due within 14 days of the invoice date. Your placement goes live once the first invoice is paid.

Customs Finder Ltd is not currently registered for VAT, so no VAT is charged on the rates quoted. If we become VAT registered during your term, VAT will be added to invoices issued after that date at the applicable rate. Our rates are exclusive of any VAT that becomes chargeable.

We can put a purchase order number on your invoices if you give us one, but a purchase order does not change these terms.

If an invoice is more than 14 days late we may pause your placement until it is paid, and the term keeps running while it is paused. We may charge interest and recovery costs under the Late Payment of Commercial Debts (Interest) Act 1998.

12. Term, renewal and ending the agreement

The term starts and ends on the dates in your order.

Either of us can end the agreement at the end of the term by telling the other at least 30 days beforehand. If neither of us does, it continues month to month on the same terms until one of us gives 30 days' notice.

Either of us may end the agreement immediately if the other commits a serious breach and does not put it right within 14 days of being asked to, or becomes insolvent.

We may end the agreement immediately if continuing it would put us in breach of the law or of an advertising code.

If we end it because of something you have done, fees for the rest of the term remain payable. If you end it because of something we have done, we will refund the unused part of any fee you have paid in advance. Other than that, fees already paid are not refundable, and the make-good in section 8 is your remedy for availability problems.

13. Data

Customs Finder has no accounts and no sign-in, and we do not collect personal data about the crews who use it. We do not pass any user data to sponsors, and we cannot, because we do not hold it. Nothing in this agreement makes either of us a processor for the other.

The only personal data involved is your own contact details, which we use to run the sponsorship and hold as described in our Privacy Policy.

14. Liability

Neither of us excludes liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot lawfully be excluded.

Subject to that, neither of us is liable to the other for loss of profit, loss of business, loss of goodwill or any indirect or consequential loss.

Subject to that, our total liability to you under this agreement is limited to the fees you have paid us in the twelve months before the claim arose.

15. General

Neither of us may transfer this agreement without the other's written consent, except that we may transfer it to a buyer of our business.

Nothing here makes us partners, or either of us an agent of the other.

Notices go to hello@customsfinder.com and to the contact address on your order. Email is fine.

This agreement is the whole agreement between us about your sponsorship, and it replaces anything said or written beforehand, including anything in our brochure or on our website. Nothing in this clause limits liability for fraud.

Someone who is not a party to this agreement has no right to enforce it.

This agreement is governed by the law of England and Wales, and the courts of England and Wales have exclusive jurisdiction.
